DOMA at your doorstep

Yesterday’s Supreme Court ruling that the Defense of Marriage Act is unconstitutional will cause clear changes in the health benefits available for some federal employees, military personnel and their families, but there are outstanding questions as to how and what degree this ruling will impact individuals newly eligible for health benefits through Obamacare’s insurance expansion. The Internal Revenue Service and the Department of Health and Human Services will be issuing clarifications as the start date for the health insurance marketplaces – January 1, 2014— approaches fast.

Hospitals and physicians need to catalog how this changing dynamic will impact the organization and prepare accordingly, from operational issues such as hospital visitation rights (as given to newly recognized married same-sex couples) to updating financial projections based on federal insurance coverage, if not state and private insurance as well depending on the laws of your state.

Regardless of personal opinion on same-sex marriage, strategists and marketers in health care cannot ignore the legal and societal shift on this issue and recognize it is prudent to prepare for it now.
